Police Clearance Requirements<\/h2>\n<h3>Directors<\/h3>\n<ul>\n<li><strong>Mandatory:<\/strong> Every director must provide a police clearance certificate.<\/li>\n<li><strong>Shareholders:<\/strong> Police clearance is <strong>nicht<\/strong> required for shareholders.<\/li>\n<\/ul>\n<h4>EU Citizens<\/h4>\n<ol>\n<li><strong>Police Clearance from Home Country<\/strong>\n<ul>\n<li>Must be an original document, issued within the last 3 months.<\/li>\n<li>Must bear an apostille stamp.<\/li>\n<\/ul>\n<\/li>\n<li><strong>OR:<\/strong> Police Clearance via CzechPoint\n<ul>\n<li>Original document, valid for certain nationalities only.<\/li>\n<li>Processing may take up to 25 days.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h4>UK Citizens<\/h4>\n<ul>\n<li><strong>Police Clearance<\/strong>\n<ul>\n<li>Must be an original document, issued within the last 3 months.<\/li>\n<li>Must bear an apostille stamp.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4>Non-EU \/ Third-Country Nationals (including US Citizens, Spouses, Registered Partners)<\/h4>\n<ol>\n<li><strong>Police Clearance from Home Country<\/strong>\n<ul>\n<li>Must be an original document, issued within the last 3 months.<\/li>\n<li>Must be apostilled or superlegalized (depending on the country of origin).<\/li>\n<\/ul>\n<\/li>\n<li><strong>US Citizens<\/strong>\n<ul>\n<li>May provide an affidavit from the U.S. Embassy instead of a criminal record extract.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Spouses \/ Registered Partners of an EU Citizen<\/strong>\n<ul>\n<li>Follow the same rules as EU citizens, <strong>provided<\/strong> they already hold a residence permit based on that relationship.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<hr \/>\n<h3>Important Details About Police Clearance<\/h3>\n<ul>\n<li>The three-month validity period starts <strong>from the date of issue<\/strong> of the police clearance, <strong>nicht<\/strong> from the date of apostille, superlegalization, or translation.<\/li>\n<li>Officially, applicants must present a police clearance from <strong>each country<\/strong> where they spent more than six months in the last three years, though there may be ways to avoid this requirement.<\/li>\n<li><strong>Translations:<\/strong> It is strongly recommended to have the police clearance translated by a court-certified translator in the Czech Republic, as foreign translations may be rejected and are often more expensive.<\/li>\n<\/ul>\n<hr \/>\n<h2>2. Additional Documents for Directors <strong>Und<\/strong> Shareholders<\/h2>\n<p>Both directors <strong>Und<\/strong> shareholders must provide the following:<\/p>\n<ol>\n<li><strong>Passport<\/strong>\n<ul>\n<li>A copy or scan of the passport.<\/li>\n<li>If applicable, include a copy of the most recent Czech visa or residence permit.<\/li>\n<\/ul>\n<\/li>\n<li><strong>(Former) Address Abroad<\/strong>\n<ul>\n<li>Provide an address in your home country (even if you no longer reside there).<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<hr \/>\n<h2>3. Czech Documents Needed for the s.r.o. Formation Process<\/h2>\n<ol>\n<li><strong>Powers of Attorney<\/strong>\n<ul>\n<li>Must be signed with notarized signatures.<\/li>\n<li>You can have this done at a CzechPoint office, a Czech notary, or a Czech embassy.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Business Seat Approval<\/strong>\n<ul>\n<li>A document signed by the property owner granting permission to use the address as the company\u2019s registered seat.<\/li>\n<li>The owner\u2019s signature must be notarized.<\/li>\n<li>Alternatively, you can submit a virtual office agreement.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Business Bank Account Agreement<\/strong>\n<ul>\n<li>Required if you are depositing share capital into an escrow account.<\/li>\n<li>This special account is later converted into a standard business account once the company is formed.<\/li>\n<li>For lower share capital amounts, an escrow account is no longer mandatory, which simplifies and speeds up the formation process.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<hr \/>\n<h3>Note on Share Capital<\/h3>\n<p>While a dedicated bank account is still advisable, Czech law allows smaller share capital contributions to bypass the escrow account requirement, making the process quicker and more efficient.<\/p>","protected":false},"excerpt":{"rendered":"<p>1.
